
EVENTIM.Fansale Terms and Conditions
Unless otherwise stated, defined terms in these EVENTIM.Fansale Terms and Conditions (“EVENTIM.Fansale Terms”) shall have the meaning given to them in the Eventim’s standard Terms and Conditions here. The following terms and conditions of use apply to the relationship between Eventim users (which may be referred to herein as “You” or “you” or “buyer” or “seller” or “user” as the context requires).
By registering on the Eventim Platform, you confirm and agree to be bound by these EVENTIM.Fansale Terms and the Eventim Standard Terms and Conditions, available here.
Registering with Eventim
To sell and purchase tickets using Eventim, you must have successfully registered for an account on the Eventim platform at eventim.co.uk (“Eventim Platform”). Registration is free.
In doing so, you represent and warrant that:
You are 18 years old or over;
You are a resident in the UK;
You have, and will continue to provide correct and complete information;
You will adhere to consumer protection regulations as set out in law and shall comply with all applicable laws, such as, without limitation, the Consumer Rights Act 2015 (as may be updated or amended from time to time), and that you will be solely liable for any breach of such laws; and
You haven’t infringed the rights of any third parties (e.g. using third party data without permission – including, but not limited to, name, address, account details, credit card details or email address).
If any claims are made against Eventim as a result of third-party rights infringement due to your use of the Eventim Services, you shall be liable for such claims.
You cannot open more than one Eventim account, and the account cannot be transferred to any third party.
To terminate your account, you must contact the Eventim Customer Service Team here. Once a termination request has been actioned by the relevant team, your user data will be deleted, or blocked if deletion is not possible due to legal, statutory or contractual retention periods.
Termination of your Eventim account will have no effect on contracts made with third parties using Eventim (e.g. if you purchase tickets from another user, or if another user purchases tickets from you). That is to say, if you have purchased or sold tickets via Eventim, you are still obligated to complete the transaction with the other user and honour any relevant terms agreed to under these EVENTIM.Fansale Terms which shall continue in effect, regardless of the status of your Eventim account.
2. Listing & Selling Tickets
i) Listing eligibility
Only tickets that were originally purchased from the Eventim Platform can be listed and sold. Eventim reserves the right to remove any other ticket listing at its discretion. You may not re-sell or transfer a ticket if prohibited by law. In addition, re-sales or transfers of tickets may be prohibited for certain events subject to the specific terms and conditions of those events (for example but not exclusively limited to charity events or events where age restrictions may apply because of content of the entertainment or licensing requirements).
ii) Setting a listing price
All listings on the Eventim Platform are fixed prices – meaning you can charge a set amount for your ticket(s), capped at the face value of the original tickets plus per-ticket booking fees (“Price Cap”), but not including other fees such as delivery, or extras such as missed event insurance.
For example, if you purchased 2x tickets with a face value of £20 per ticket, plus a £2 per ticket booking fee and an order delivery fee of £2.50, you can list both tickets together for a maximum of £44. You can also list tickets at a lower value than the Price Cap including listing such tickets for free, if you wish to do so.
If you select ‘set price to fair deal’, this will automatically set your listing price to the maximum value possible, subject to the Price Cap.
iii) Fees
You (as the seller) will not be charged any fees for creating a listing or for any tickets sold from your listings.
iv) Setting the listing duration
If tickets are eligible to be reissued directly by Eventim, they can be listed until 4 (four) hours before the start time of the event detailed on the ticket. If tickets are not eligible to be reissued directly by Eventim, they can be listed until 5 (five) days before the event date. Alternatively, specific start and end dates / times can be set per listing if desired. If not sold by the listing end date and time, the listing will expire and the tickets will no longer be displayed on the Eventim Platform.
v) Listing terms and conditions
By listing tickets on the Eventim Platform, you represent and warrant that:
You are either the original ticket holder or the tickets were legitimately transferred to you (e.g. as a gift);
You have not listed the tickets for sale on any other resale or similar platform; and
You agree to transfer the listed tickets to the buyer, if sold, in accordance with the delivery terms (and any other relevant terms) under these EVENTIM.Fansale Terms.
Listing tickets with Eventim does not guarantee that they will be purchased by another user.
When listing tickets on the Eventim Platform, you must provide to the buyer full details of the ticket. You should check whether any special terms apply before offering a free ticket for resale. Other terms which apply to the resale of tickets are as per the Eventim Standard Terms and Conditions, which shall also apply to buyers and sellers under these EVENTIM.Fansale Terms.
vi) Editing a listing
Once tickets have been listed but have not yet been purchased, you may edit the listing to:
Change the selling price of the tickets (e.g. reducing the price to incentivise other users to purchase the tickets), but subject to the conditions on setting a listing price under Clause 2(ii) above (Setting a listing price).
vii) Removing a listing
Subject to this Clause 2(vii), you may only remove a ticket listing provided that none of the listed tickets have been purchased. If you’d like to remove your listing, you can do so via your Eventim account, or for further assistance please contact Eventim Customer Service here. A maximum of 5 (five) listings can be removed per user, across the lifetime of their Eventim account. Any further requests to remove a listing are subject to the discretion of the Eventim Customer Service Team.
If one or more tickets in the listing have been sold, you are obligated to transfer the sold ticket(s) to the buyer and as such are not permitted to remove the full listing, but you may remove any unsold tickets remaining in the listing.
viii) Seller duties
The seller is obligated to:
Adhere to the listing terms and conditions as set out above.
Respond in a timely manner to communications from other users regarding queries for tickets listed, or from buyers regarding tickets sold.
If sold tickets are not eligible to be reissued by Eventim:
Dispatch such tickets which have been sold to the seller via Royal Mail, when requested to do so by Eventim and in accordance with the delivery requirements in Clause 3(i) below (Delivery).
If Royal Mail has not confirmed delivery of sold tickets within 14 (fourteen) days of the seller being requested to dispatch them, or by 48 hours prior to the event date (whichever is the earlier), Eventim reserves the right not to transfer payment to the seller and to consequently issue a refund to the buyer – except in the case that the tickets have not yet been dispatched or delivered to the seller (in such cases, the seller must dispatch the tickets to the buyer once they have been received, and no later than five days prior to the event date).
If sold tickets are eligible to be reissued by Eventim:
The seller shall have no further obligations in terms of ticket fulfilment.
Once sold, tickets will be cancelled and subsequently become void. Eventim will then reissue new, valid replacement tickets to the buyer.
3. Purchasing tickets
i) Delivery
a) Via Royal Mail for tickets that are not eligible to be reissued directly by Eventim
If the tickets are not eligible to be reissued directly by Eventim, the seller will be required to dispatch their tickets to the buyer directly via Royal Mail only.
Fulfilment of the order will be handled solely by the seller, who will be required to:
Print the shipping label (this will be available via the Eventim Platform), and affix this to the packaging used to send the tickets to the buyer; and
Dispatch the tickets via Royal Mail. The seller can choose to have the tickets collected by Royal Mail from a nominated address, or leave the tickets at their local Royal Mail collection point.
Sellers must not include any form of advertising in the shipment to the buyer; including, but not limited to, vouchers, business cards, flyers, brochures, catalogues, or information about websites or services.
Once tickets have successfully been delivered, the buyer has 48 hours to report any discrepancies to the Eventim Customer Service Team (e.g. incorrect tickets). If no discrepancies are reported, Eventim will transfer the payment to the seller, minus the booking and delivery fees charged. If a discrepancy is reported within such 48 hour period, transfer of payment to the seller shall be automatically put on hold while the Eventim Customer Service Team investigates and a resolution is found.
ii) Buyer duties
The buyer is obligated to:
Pay Eventim the listed price of the tickets purchased, including booking and delivery fees with payment being taken once the buyer has completed the checkout process.
In the case that tickets are being dispatched via Royal Mail by the seller:
The buyer shall inform the Eventim Customer Service Team here if the buyer is aware that purchased tickets haven’t been dispatched by the seller one week prior to the event date.
In such a case, the buyer is entitled to request cancellation of the order and claim a refund, inclusive of the booking and delivery fees paid. If the buyer does not inform the Eventim Customer Service Team as detailed, Eventim is entitled to transfer payment to the seller in accordance with Paragraph 3(i)( above (Delivery).
The buyer shall Inform the Eventim Customer Service Team here if the buyer is aware that purchased tickets have been dispatched by the seller, but not received 48 hours prior to the event.
In such a case, the Eventim Customer Service Team will investigate and, if possible and practicable, provide alternative means to ensure that the tickets are accessible to the buyer in time for the event.
Report a discrepancy if the purchased tickets have been delivered but are not as described in the listing (e.g. if tickets are missing or damaged, or if tickets are not for the correct date or show), within 48 (forty-eight) hours of delivery.
In the case of a dispute, either of the two parties may contact the Eventim Customer Service Team here for assistance with dispute resolution.
If discrepancies are not reported within 48 (forty-eight) hours of delivery, Eventim will deem the tickets successfully delivered and transfer the payment amount to the seller, and as such will no longer be liable to assist with dispute resolution or issue a refund to the buyer. The buyer will then be solely responsible for dispute resolution and / or arranging a refund with the seller.
iii) Purchasing terms and conditions
Upon the sale of one or more tickets in a listing, both the seller and buyer are deemed to have entered an exclusive contractual agreement and as such, both parties are bound by their respective obligations, as set out in these EVENTIM.Fansale Terms, in order to complete the transaction – including, but not limited to, ticket delivery and communicating with each other via Eventim as required.
Such obligations do not include transfer of the payment amount to the seller – which shall be handled by Eventim in accordance with these terms and conditions.
In the case that tickets are being dispatched via Royal Mail by the seller:
Purchases may only be cancelled if the seller and buyer both agree to cancel the purchase in writing and subsequently notify the Eventim Customer Service Team here of such cancellation, or if either the seller or buyer are in breach of their individual duties as detailed above. Upon cancellation, the buyer will be issued a refund of the total cost of their Eventim order.
If a show is cancelled, the seller will receive a refund on the original order (as the original purchaser of the tickets). It is then the seller’s responsibility and the seller agrees to issue a refund to the buyer. Refunds should be organised between both parties, and should be for the amount that the seller received from Eventim from the sale of the tickets on Eventim.
iv) Disputes
In the case of any disputes, You agree that it shall be resolved via Clause 19 of the Eventim Standard Terms and Conditions.
4. General terms of use
i) Advertising
Any type of advertisement, self-advertisement or links to third party websites are not permitted on Eventim – including, but not limited to, ticket listings and messages between Eventim users.
ii) User data
If the seller is required to send sold tickets directly to the buyer, a Royal Mail shipping label will be generated via Eventim, including personal data of one or both parties (e.g. name and delivery address). The sole use of this data is to fulfil ticket delivery in order to complete the Eventim transaction. Neither party is permitted to retain or use this data for any other purpose, including but not limited to, advertising or correspondence. Any party in breach of this shall be completely liable for any claims or damages awarded as a result of such breach – Eventim will accept no liability for a user’s misuse of personal data.
Eventim accepts no liability for the accuracy of data entered into Eventim by its users. If the date or time are decisive for transactions, the date and time on the Eventim system shall apply.
iii) Communication between users
All communication between Eventim users must take place exclusively on the Eventim Platform. Communications must not include profanity, advertisements, harassment, or any other content not related to a ticket listing or purchase made on Eventim.
iv) Technology
The use of bots and / or any methods of mass purchasing tickets is forbidden. Users in breach of this will have their accounts terminated with immediate effect at the discretion of Eventim.
If the Eventim Platform undergoes maintenance and / or downtime, due to technical or other reasons, leaves users unable to use Eventim, Eventim reserves the right to extend the length of a listing, where possible.
5. Guarantee of Authenticity
All tickets listed on the Eventim Platform have undergone a successful barcode check and been verified as legitimate, valid tickets.
If a buyer is denied entry to an event they purchased tickets for via the Eventim Platform, due to the event venue or promoter questioning and subsequently rejecting the authenticity of the purchased Eventim tickets, the buyer shall ask the event Venue or Promoter to provide written confirmation of denied entry for this reason.
Once this confirmation is passed on to and verified by the Eventim Customer Service Team, Eventim will reimburse to the buyer:
The purchase price of the ticket;
Booking fee; and
Delivery fee.
Other costs, including but not limited to, replacement tickets, travel and accommodation costs, will not be reimbursed by Eventim.
Such reimbursement can be actioned for a maximum of two events per user, the total not exceeding more than £250.00 per calendar year (from 1 January to 31 December).
Alternatively, time-permitting and at Eventim’s discretion, Eventim may provide the buyer with replacement original tickets for the event, subject to availability.
6. Miscellaneous
Eventim may use third parties in order to fulfill its Eventim service (e.g. Royal Mail), and to exercise its rights as the owner and operator of Eventim.
