Eventim FanBonus - Terms and Conditions of Participation

The ticket loyalty scheme, FanBonus (“FanBonus”) is operated by EVENTIM UK Ltd (“EVENTIM”). The following terms and conditions of use apply to the relationship between FanBonus users (“you” , “your” or “FanBonus Member” as required) and EVENTIM. By registering as a FanBonus Member and / or using FanBonus and/or the FanBonus website, you confirm that you agree to be bound by these terms and conditions and any other relevant terms which apply under EVENTIM’s Standard Terms and Conditions, available here.

1. Registering with FanBonus

Customers can become FanBonus Members by signing up, free of charge. Existing eventim.co.uk users can use their account details to log in to FanBonus.

By registering for FanBonus or creating an eventim.co.uk account, or by using FanBonus you certify that:

• You are 18 years old or over;

• You are resident in the UK;

• You have provided correct and complete information;

• You will adhere to consumer protection regulations as set out in law and shall comply with all applicable laws, such as, without limitation, the Consumer Rights Act 2015 (as may be updated or amended from time to time), and that you will be solely liable for any breach of such laws;

• You haven’t infringed the rights of any third parties (e.g. using third party data without permission – including, but not limited to, name, address, account details, credit card details or email address).

If any claims are made against EVENTIM as a result of third-party rights infringement on the part of a FanBonus Member or eventim.co.uk user, that user shall be liable for such claims.

Once successfully registered for FanBonus or as an eventim.co.uk account holder, you will be able to log in to FanBonus and eventim.co.uk with your username (your email address) and the password set during registration. You can change your password at any time. FanBonus and eventim.co.uk users are obligated to keep their login information safe and secure from third parties, and for keeping their personal data up to date (e.g. if you have a new home address or email address).

You cannot open more than one FanBonus or eventim.co.uk account, and the account cannot be transferred to any third party. EVENTIM reserves the right to refuse, merge or close additional accounts at any time.

For your first order as a FanBonus Member to be eligible, you must sign up prior to, or within 24 hours of making the purchase.

EVENTIM reserves the right to terminate user accounts at any time. You reserve the right to terminate your FanBonus or eventim.co.uk account at any time, without giving a reason. To do this, you must either contact the FanBonus Customer Service Team here, or the EVENTIM Customer Service Team here. Once a termination request has been actioned by the relevant team, your user data will be deleted, or blocked if deletion is not possible due to legal, statutory or contractual retention periods.

2. Ticket Orders

For every ticket order placed through eventim.co.uk, FanBonus Members can receive three percent (3%) of the respective ticket price (including ticket and system fees as well as shipping costs, and with a deduction of all marketing, gift and FanBonus vouchers and other discounts) (the “Ticket Price”), credited onto their FanBonus Membership account (“Credits”) in the form of an online voucher code (“Voucher”). Any subsequently cancelled ticket orders are not included.

Ticket orders placed via fansale.co.uk and / or our partner sites (e.g. eventim.tixuk.com) are not eligible.

If a FanBonus Member redeems the Voucher for a ticket order which they then cancel and / or do not pay for, the Voucher loses its validity and expires without any compensation.

Only ticket orders which are fully completed and fully paid for within one calendar year from 1 January – 31 December (“Year”) are included in the settlement in January of the following Year; orders paid later are taken into account for the following Year.

3. Voucher Redemption

The Credits accumulated are totalled each Year. In January of the following Year, FanBonus Members are sent an email with their FanBonus Voucher to the amount of three percent (3%) of the Ticket Price of all tickets purchased by the customer during the previous Year.

It is the FanBonus Member’s responsibility to keep their personal details updated on their FanBonus account. EVENTIM shall not be responsible for loss of Credits, Vouchers or if Voucher emails are not received by FanBonus Members for any reason – including, but not limited to, technical errors and internet connection issues.

If FanBonus Members don’t receive their Voucher email as expected by 31 January of the following Year, it is their responsibility to contact the EVENTIM customer service team here for further assistance.

The Voucher is valid for six months after being sent to the FanBonus Member’s email. The expiry date will be stated alongside the Voucher in the email. Once expired, Vouchers cannot be redeemed or reissued.

The Credits accumulated per Year on the membership account cannot be paid out in cash, transferred and / or credited elsewhere. Credits can only be used by the FanBonus Member who is named and registered on the FanBonus account. After redeeming the Voucher, any remaining Credit expires without compensation.

The maximum FanBonus Voucher amount that can be earned and credited to a FanBonus Member per Year is £10. Additional ticket purchases within the Year that exceed a total Ticket Price of £333.33 will not be considered and are forfeited with no credits earned.

Vouchers can be redeemed online only at eventim.co.uk

Every Year on 1 January, each FanBonus Member’s Credits will reset to zero; Credits cannot be carried forward to the following Year. At the beginning of each new Year, each FanBonus Credit amount for eligible ticket orders starts from zero.

Only one Voucher can be redeemed per ticket order.

The Voucher cannot be combined with any other (promotional and / or gift) vouchers and / or discounts.

The Voucher can only be used individually by the FanBonus Member and cannot be transferred to other customers and / or FanBonus Members. Active employees of the CTS Eventim group are excluded from the FanBonus membership.

4. Misuse of FanBonus

EVENTIM may decline to issue, withdraw, block or cancel Credits or Vouchers in whatever form and/or remove a FanBonus Member at any time or take other appropriate action as deemed necessary, if:

• There is any indications of any abuse or attempted abuse of FanBonus;

• Any attempts to transfer or resell tickets at inflated prices and / or via unauthorised resale platforms;

• Any measures are taken to circumvent ticket limits in place for any event(s) that tickets are purchased, i.e. by mass purchasing a greater quantity of tickets than permitted by any ticket limit in place;

• Any other breach or attempted breach of these Terms and Conditions of Participation or EVENTIM Standard Terms and Conditions.

5. Miscellaneous

EVENTIM reserves the right to, at its own discretion:

• to discontinue the FanBonus loyalty scheme or any element of it or vary it at any time. EVENTIM will let FanBonus Members know in advance of any significant changes to the FanBonus loyalty scheme;

• change the Terms and Conditions of Participation. EVENTIM will inform FanBonus Members about these changes with timely notice; and

to assign wholly or partially its rights and obligations in respect of the fanSALE service to a third party.

6. Liability

By registering for a FanBonus or eventim.co.uk account or by using FanBonus, you indemnify EVENTIM against any type of action, damages, loss, costs, penalties or demands that may arise as a result of your registration and subsequent use of FanBonus, where such registration and subsequent use contravenes these terms and conditions or the law.

Nothing in these Terms and Conditions of Participation seeks to exclude or limit EVENTIM’s liability for death or personal injury caused by EVENTIM’s negligence, fraud or other type of liability which cannot by law be excluded or limited.

EVENTIM shall have no liability to you for any loss or any damages (including direct, indirect, consequential, incidental and exemplary) in the event that FanBonus is unavailable (including any interruption, suspension or termination) for any reason, including due to computer or communications link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities.

EVENTIM shall have no liability to you in respect of any loss or damage (including direct, indirect, consequential, incidental and exemplary) which may be suffered or incurred or which may arise directly or indirectly in respect of your use of FanBonus.

Unless prohibited by law, EVENTIM’s maximum aggregate liability under or in connection with these Terms and Conditions of Participation whether in contract, tort (including negligence) or otherwise, shall in all circumstances be limited to £10.

7. General

If we decide not to exercise or enforce any right that we have against you at a particular time, then this does not prevent us from later deciding to exercise or enforce that right.

Each of the conditions of these Terms and Conditions of Participation operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.

These Terms and Conditions of Participation shall be governed by and construed in all respects in accordance with English law and You can bring legal proceedings in respect of the tickets in the English courts. If You live in Scotland You can bring legal proceedings in respect of the tickets in either the Scottish or the English courts. If You live in Northern Ireland You can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
